Declarations of Interest

To receive declarations by Members of interests in respect of items on this Agenda.

 

Members are reminded that, in accordance with the revised Code of Conduct, they are required to declare any disclosable pecuniary interests or other registrable interests which have not already been declared in the Council’s Register of Interests.  (It is a criminal offence not to declare a disclosable pecuniary interest either in the Register or at the meeting.)

 

Members may, however, also decide, in the interests of clarity and transparency, to declare at this point in the meeting, any such disclosable pecuniary interests which they have already declared in the Register, as well as any other registrable or other interests.

 

If a Member requires advice on any item involving a possible declaration of interest which could affect his/her ability to speak and/or vote, he/she is advised to contact the Monitoring Officer at least 24 hours in advance of the meeting.

a) To note the following Terms of Reference for the Lake Administration

Committee in accordance with the Council’s Constitution:-

 

“The functions of the Council in relation to the management of land at Lake

Windermere pursuant to an agreement dated 1 April 1975 between the

Council, Windermere Parish Council and Lakes Parish Council as set out in

Regulations 2(10) of the Functions Regulations.”

 

b) To note the Agreement for the Constitution of the Lake Administration

Committee as agreed in 1975.

To consider an update on progress relating to decisions made at previous meetings of the Committee, as at 26 June 2019.

Minutes:

Members gave consideration to a report which provided an update on progress being made on decisions taken at previous meetings of the Committee.

 

A suggestion was raised for the need to achieve a Green Agenda for the Lake in order to assure best safety and quality of water for the Lake and those who use it.

To consider annual reports from Members appointed to serve on outside bodies

during 2018/19 and to nominate representatives to serve on outside bodies for

the forthcoming year, 2019/20.

The Committee gave consideration to a report including an update from former Councillor Andrew Butcher on the work of the Windermere Lake Action Plan Steering Group during 2018/19 and seeking nominations for representatives to serve on both that Steering Group and the Windermere Ferry Advisory Committee for the forthcoming year.

 

RESOLVED – That

 

(1)        the report from former Councillor Andrew Butcher on the work of the Windermere Lake Action Plan Steering Group during 2018/19 be noted; and

 

(2)        the following appointments of representatives to serve on outside bodies for 2019/20 be made:-

Commercial Encroachment Application to install a new wooden jetty and concrete slipway to include dredging at Hodge Howe Watersports Centre Windermere pdf icon PDF 128 KB

To consider an encroachment application to install a new wooden jetty and concrete slipway, to include dredging, at Hodge Howe Watersports Centre, Windermere.

The Lake and Parking Services Officer presented a report outlining an encroachment application at Hodge Howe Watersports Centre, Windermere, which formed the third campus of Windermere School. The application sought to install a new wooden jetty and concrete slipway at Hodge Howe Watersports Centre, alongside the dredging of the Lake bed and associated works to facilitate landing of the applicant’s boats. The report highlighted that the application was fully supported by Officers at South Lakeland District Council (SLDC) as well as by the Lake District National Park Authority (LDNPA) and the Environment Agency (EA). SLDC, the LDNPA and the EA all believed that the applicant could complete the works without breaching the permit conditions, harming the environment or increasing flood risk.

 

RESOLVED – That the Director of Customer and Commercial Services be delegated authority to grant permission, subject to the completion of a revised commercial encroachment agreement, for the following at Hodge Howe, Windermere:-

 

(1)        installation of a new wooden jetty;

 

(2)        installation of a concrete slipway; and

 

(3)        undertaking dredging.

Encroachment Application to extend the Northern jetty at Hill of Oaks Caravan Park Windermere pdf icon PDF 129 KB

To consider an Encroachment Application to extend the Northern jetty at Hill of Oaks Caravan Park, Windermere.

The Lake and Parking Services Officer presented a report outlining an encroachment application at Hill of Oaks and Blakeholme Caravan Park, Windermere. The application sought to extend the northern jetties by 10 metres and to remove rotten elements from the jetties. The report highlighted that the application was fully supported by Officers at South Lakeland District Council (SLDC) as well as by the Lake District National Park Authority (LDNPA) and the Environment Agency (EA). SLDC, the LDNPA and the EA all believed that the applicant could complete the works without breaching the permit conditions, harming the environment or increasing flood risk.

 

The Lake and Parking Services Officer informed Members of the moorings that would have to be moved in order for the proposed development to be completed.  He also highlighted that the applicant would pay for the relocation of any moorings impacted by the proposed development.

 

RESOLVED – That the Director of Customer and Commercial Services be delegated authority to grant permission, subject to the completion of a revised commercial encroachment agreement, for the following at Hill of Oaks and Blakeholme Caravan Park, Windermere:-

 

(1)        removal of rotten and all timber decking and piles from the northern timber jetty; and

 

(2)        replacement of jetty to match existing, together with 10 metre extension to the northern jetty.

Press and Public

Minutes:

RESOLVED – That, under Section 100(A)(4) of the Local Government Act 1972, the press and public be excluded from the meeting for the following item of business on the grounds that it involves the likely disclosure of exempt information as defined in Part 1 of Schedule 12 A of the Act as amended by the Local Government (Access to Information) (Variation) Order 2006 by virtue of the Paragraphs indicated.

Update on commercial leases and annual encroachments

To update Members on commercial leases and annual encroachments.

Minutes:

The Legal, Governance and Democracy Interim Lead Specialist presented a report which provided Members with an update regarding commercial leases and annual encroachments around the Lake.

 

Members wished to place on record recognition of the work carried out by the former Solicitor to the Council and her Team in management of encroachment fees.

RESOLVED – That the press and public be re-admitted to the meeting for the remainder of the meeting.
