DECLARATIONS OF INTEREST

To receive declarations by Members of interests in respect of items on this Agenda.

 

Members are reminded that, in accordance with the revised Code of Conduct, they are required to declare any disclosable pecuniary interests or other registrable interests which have not already been declared in the Council’s Register of Interests.  (It is a criminal offence not to declare a disclosable pecuniary interest either in the Register or at the meeting.)

 

Members may, however, also decide, in the interests of clarity and transparency, to declare at this point in the meeting, any such disclosable pecuniary interests which they have already declared in the Register, as well as any other registrable or other interests.

 

If a Member requires advice on any item involving a possible declaration of interest which could affect his/her ability to speak and/or vote, he/she is advised to contact the Monitoring Officer at least 24 hours in advance of the meeting.

THE GAMBLING ACT 2005 - STATEMENT OF GAMBLING LICENSING POLICY pdf icon PDF 165 KB

To consider the draft revised Statement of Gambling Policy which is to be the subject of a three months consultation process. The result of that process will be reported for consideration to the Licensing Committee on 19 January 2016 before being recommended to full Council.

The Committee was requested to consider proposed arrangements for a review of the Council’s Statement of Gambling Licensing Policy in accordance with the timetable stipulated in the Gambling Commission guidance to local authorities (fourth edition). The Council’s Policy had last been amended in 2012 and the proposed revision was needed to reflect national and legislative policy changes. The new Policy would provide a licensing framework for stakeholders within South Lakeland.

 

It was explained to Members that the report’s original recommendation had been for the results of the consultation to be reported to the Licensing Committee on 19 January 2016, however it was requested that this be amended to the meeting of 10 December 2015.

 

Following questions from the Licensing Committee, the Public Protection Manager said that she would provide Members with further information on small society lotteries. The Public Protection Manager also provided clarification on questions surrounding forms of gambling which would not be covered by the local Policy.

 

The Committee expressed its approval of the partnership working with neighbouring authorities which had been conducted during the preparation of the statement. It also requested that any feedback gained during the subsequent consultation period, where appropriate, be shared with these partners.

 

RESOLVED – That

 

(1)      approval be given for the draft revised Statement of Gambling Licensing Policy, as attached at Appendix 1 to the report, to be subject to consultation with stakeholders over a three month period commencing 31 August 2015 to 20 November 2015; and

 

(2)      the results of the consultation be reported to the Licensing Committee on 10 December 2015 for consideration before being forwarded to full Council with any proposals for adoption.
