RESOLVED – That the minutes of the meeting of the Licensing Sub-Committee held on 4 November 2021 be received and the Chairman of that Sub-Committee be authorised to sign as a correct record.

Declarations of Interest

To receive declarations by Members of interests in respect of items on this Agenda.

 

Members are reminded that, in accordance with the revised Code of Conduct, they are required to declare any disclosable pecuniary interests or other registrable interests which have not already been declared in the Council’s Register of Interests.  (It is a criminal offence not to declare a disclosable pecuniary interest either in the Register or at the meeting.)

 

Members may, however, also decide, in the interests of clarity and transparency, to declare at this point in the meeting, any such disclosable pecuniary interests which they have already declared in the Register, as well as any other registrable or other interests.

 

If a Member requires advice on any item involving a possible declaration of interest which could affect his/her ability to speak and/or vote, he/she is advised to contact the Monitoring Officer at least 24 hours in advance of the meeting.

The Licensing Act 2003 - Review of Statement of Licensing Policy pdf icon PDF 254 KB

To consider the results of a formal six week consultation period and recommendation to full Council of the revised Statement of Licensing Policy.

The Principal Specialist (Health & Environment) presented a report which detailed the results of the formal six week consultation process of the revised Statement of Licensing Policy that had been approved at the Licensing Committee meeting on 29 November 2021. He informed Members that one response to the consultation had been received, and the Licensing Authority had responded. He further informed Members that, as a result of the consultation and following consideration of the response which had been received, no amendments had been made to the revised Policy which had been approved by Members at the Licensing Committee meeting 29 November 2021.

 

Discussion took place regarding a particular premises in the district that had been granted a licence, where issues had been raised regarding the condition of the structure of the building.  Members were advised by the Principal Specialist (Health & Environment) that licensing, planning, and building regulations were different regimes. There was further discussion regarding possible procedures to ensure that all relevant parties were consulted on licensing applications and allow comments to be made as necessary. 

 

RESOLVED – That

 

(1)        the responses received to the consultation be noted; and

 

(2)        Council be recommended to adopt the revised Statement of Licensing Policy.
