DECLARATIONS OF INTEREST

To receive declarations by Members of interests in respect of items on this Agenda.

 

Members are reminded that, in accordance with the revised Code of Conduct, they are required to declare any disclosable pecuniary interests or other registrable interests which have not already been declared in the Council’s Register of Interests.  (It is a criminal offence not to declare a disclosable pecuniary interest either in the Register or at the meeting.)

 

Members may, however, also decide, in the interests of clarity and transparency, to declare at this point in the meeting, any such disclosable pecuniary interests which they have already declared in the Register, as well as any other registrable or other interests.

 

If a Member requires advice on any item involving a possible declaration of interest which could affect his/her ability to speak and/or vote, he/she is advised to contact the Monitoring Officer at least 24 hours in advance of the meeting.

Minutes:

Gordon Sloane, a local taxi operator, spoke in opposition to any proposed fare increase. He accepted that the reduction in fuel prices was helping to reduce costs but suggested that the Council should reconsider its policy relating to the age of vehicles to enable older vehicles to be used as taxis. He also requested that vehicle advertising policy be reviewed to enable wrap around advertising on vehicles which would increase income.

 

Michael Pierson, representing the Taxi Association, also spoke in opposition to proposed increases in taxi fares. He informed Members that it was the general consensus of the Association members that an increase in fares would have a devastating affect on member’s income. He was of the view that shoppers and elderly people would be more inclined to use buses. He asked the Committee to consider increasing the number of taxi vehicle spaces in Kendal and Windermere. He added that Taxi operators were finding the need to park in no parking areas and risk parking fines.

To note the proposed budgets which will be used as a basis for committing expenditure and monitoring income and expenditure during 2015/16.

The Financial Services Officer presented a report setting out the draft budgets to be used as a basis for committing expenditure and monitoring income and expenditure during 2015/16. He emphasised that the 2014/15 employee costs were included in Departmental Recharges; whereas in the 2015/16 draft budgets these costs had been transferred directly to Employees budgets and consequently, the Departmental Recharges had been reduced. Fees relating to the cyclical renewal of personal licences shown in Appendix 1 had now been made free of charge by Central Government and consequently, Customer Receipts totalling £30,000 had now been removed from the draft budgets. Costs totalling circa £20,000, which related to supporting the Licensing Committees, were held in other departmental budgets and therefore, did not appear in the budget costs shown in Appendix 1 to the report.

 

In response to a Member’s question, the Financial Services Officer informed the Committee that savings had been achieved in a number of areas such as assets in Ulverston and in waste contract areas.

 

RESOLVED – That the latest draft estimates for the Licensing Regulatory Committee and Licensing Committee be noted.

REVIEW OF LICENSING FEES AND CHARGES 2015/16 pdf icon PDF 149 KB

To consider the proposed changes to the Licensing Fees and Charges 2015/16.

The Principal Food, Licensing and Safety Officer presented a report which proposed increases to certain fees and charges for licensable activities, hackney carriage and private hire licensing, to work towards recovering costs in those areas.

 

Members noted that the term ‘CRB’ should be replaced with the term ’DBS’ in Appendix 1 to the report and the words ‘or renewal’ needed to be removed from the licence type in Appendix 2 of the report on page 18.

 

In response to Members’ questions, the Principal Food, Licensing and Safety Officer informed the Committee that the cost of administering and issuing licenses would be monitored and reviewed in 2016/17 and the possibility of reducing fees would also be considered with a view to revenue being increased. A cost comparison with neighbouring Councils would be part of the review.

 

RESOLVED – That the fees as set out in Appendices 1 and 2 to these Minutes to the report be adopted for the financial year 2015/16.

LOCAL GOVERNMENT (MISCELLANEOUS PROVISIONS) ACT 1976 - PROPOSED VARIATION OF HACKNEY CARRIAGE FARES pdf icon PDF 177 KB

To consider whether to vary the maximum fares that may be charged by hackney carriage proprietors during the period 2015 to 2016.

The Licensing Officer presented a report which requested the Committee to determine whether to vary the fares that may be charged by hackney carriage proprietors during the period 2015 to 2016. In response to a question, he informed the Committee that since 2012, there had been 243 taxis licensed in the District which was an increase of 22 since 2012.

 

RESOLVED – That there be no modification to the maximum fares that may be charged by hackney carriage proprietors as set out in the report as proposal 1.
